Welcome to Smultron ("App", "we", "our", or "us"). By downloading, installing, accessing, or using our App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our App.

These Terms constitute a legally binding agreement between you and Smultron regarding your use of the App. Please read them carefully.

2. Description of Service

Smultron is a mobile application that enables users to discover, share, and explore outdoor locations throughout Sweden. Our community-driven platform allows users to:

• Discover: Find interesting outdoor locations submitted by the community
• Save: Create personal collections of favorite locations (unlimited for all users)
• Submit: Share new outdoor locations with photos and descriptions (free users: 1 location, premium users: unlimited)
• Rate: Provide ratings and feedback on community locations
• Browse: Explore locations by municipality and category
• Connect: Participate in a community of outdoor enthusiasts
• Achieve: Earn badges based on submission milestones (1, 10, 25, 50, 100+ submissions) [COMING SOON]

3. Eligibility and Account Requirements

3.1 Age Requirements

• You must be at least 17 years of age to use this App
• We comply with applicable laws regarding minors

3.2 Account Registration

To access certain features, you must register for an account by providing:

• A valid email address and password, or
• Apple Sign In authentication

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and current information
• Notifying us immediately of any unauthorized use

4. Subscription Tiers and Features

4.1 Subscription Tiers

Free Tier:

• Save unlimited locations
• Submit 1 location to the community
• View and rate all community content
• Basic app functionality
• Achievement badges based on submission count [COMING SOON]

Premium Tier:

• All free tier features
• Unlimited location submissions
• Ability to comment on locations
• Priority support
• Access to future premium features

4.2 Billing and Payments

• Subscriptions are handled exclusively through Apple App Store
• Available plans: Monthly and Annual subscriptions
• Subscription terms and billing are governed by Apple's App Store policies
• We do not store your payment information
• Subscription management is done through your device's App Store settings

4.3 Subscription Changes

• You may upgrade, downgrade, or cancel your subscription anytime through Apple App Store
• Changes typically take effect at the next billing cycle
• Cancelled subscriptions remain active until the end of the current billing period
• Refunds are subject to Apple App Store policies

5. User-Generated Content

5.1 Location Submission Guidelines

Submission Limits:

• Free users: 1 location submission
• Premium users: Unlimited location submissions
• All submissions are subject to community guidelines

Required for all submissions:

• ✅ Must be an actual outdoor location within Sweden
• ✅ Must be freely and publicly accessible
• ✅ Must include 1-5 recent, original photos
• ✅ Must provide accurate GPS coordinates
• ✅ Must include a clear, descriptive name and description

Prohibited:

• ❌ Private properties or locations requiring special permission
• ❌ Indoor venues or enclosed spaces
• ❌ Fictional, non-existent, or mislocated places
• ❌ AI-generated, stock, or copyrighted images
• ❌ Duplicate submissions
• ❌ Locations that promote illegal activities
• ❌ Locations published to promote your own business or services

5.2 Content Ownership and Licensing

Your Rights:

• You retain ownership of all content you submit
• You can delete your account, which removes your personal data

License to Us:

By submitting content, you grant Smultron a worldwide, non-exclusive, royalty-free, sublicensable license to:

• Use, reproduce, and display your content in connection with the App
• Store and distribute your content to other users
• Modify content for technical requirements (e.g., resizing images, optimization)
• Modify, remove or hide any content you submit without your consent (typically only done in case of abuse, misleading or illegal content)

Community Content:

• Location submissions become part of the shared community database
• Data related to your submitted content can be edited by us without your consent (solely with the best interest of the community in mind)

5.3 Content Standards

All content must be:

• Appropriate: Family-friendly and suitable for all users
• Accurate: Truthful and not misleading
• Original: Your own content or content you have rights to use
• Legal: Compliant with all applicable laws and regulations
• Respectful: Not harassment, discriminatory, or offensive

5.4 Content Moderation

We reserve the right to:

• Review all submitted content
• Edit or delete any data related to submitted content (solely with the best interest of the community in mind)
• Remove content that violates our terms without any warning
• Suspend or terminate accounts for repeated violations, which may or may not be permanent
• Use automated and manual moderation systems

6. Prohibited Conduct

You agree not to:

6.1 Technical Violations

• Attempt to gain unauthorized access to the App or our systems
• Use automated tools to scrape or collect data from the App
• Interfere with or disrupt the App's functionality
• Upload malware, viruses, or malicious code
• Reverse engineer or modify the App
• Circumvent rate limits or submission restrictions

6.2 Content Violations

• Submit false, misleading, or inaccurate information
• Post content that infringes intellectual property rights
• Share personally identifiable information of others without consent
• Upload content containing hate speech, harassment, or threats
• Promote violence, illegal activities, or harmful behavior
• Submit locations that are illegal for the general public to access
• Submit locations that aren't free of charge to enter

6.3 Community Violations

• Impersonate any person or entity
• Harass, threaten, or intimidate other users
• Engage in spam or unauthorized advertising
• Create multiple accounts to circumvent restrictions
• Use the App for any commercial purposes without our consent

7. Location Services and Safety

7.1 Location Data Usage

Our App uses location services to:

• Enable distance-based sorting and discovery
• Validate that submitted locations are within Sweden
• Provide location-relevant content

Important: Location access is privacy-first and on-demand only:

• Your device location is only accessed when you explicitly request distance-based features
• Location requests are rate-limited (maximum 2 requests per 10 seconds) to protect privacy and battery

7.2 Safety Disclaimers

We strongly recommend:

• Checking current weather and conditions
• Informing others of your travel plans
• Bringing appropriate safety equipment
• Respecting private property and local regulations
• Following Leave No Trace principles

7.3 Location Accuracy

• GPS coordinates may not be perfectly accurate
• Location accessibility can change due to weather, season, or regulations
• Always verify current conditions and access permissions
• Use additional navigation tools and local knowledge

8. Privacy and Data Protection

8.1 Privacy Policy

Our Privacy Policy, incorporated by reference, explains how we collect, use, and protect your information. Key points:

• Privacy-First Design: Minimal data collection with user control
• On-Demand Location: Location only accessed when explicitly requested
• User Rights: Comprehensive data control and deletion options

• Rate Limiting: Automatic protection against excessive data requests

8.2 Data Retention

• Personal data is deleted when you delete your account
• Usage data may be retained in anonymized form for service improvement

9. Intellectual Property

The App, including its design, features, and underlying technology, is owned by Smultron and protected by intellectual property laws.

9.2 Your Rights

You retain ownership of your submitted content but grant us necessary licenses to operate the service.

9.3 Respect for Others' Rights

You must not submit content that infringes others' intellectual property rights.

10. Disclaimers and Limitations

10.1 Service Availability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." We do not guarantee:

• Uninterrupted or error-free service
• Accuracy of all location information
• Availability of all features at all times
• Compatibility with all devices or operating systems

10.2 Content Disclaimers

• User-Generated Content: We do not verify or endorse user submissions
• Location Information: Accuracy and accessibility of locations may change
• Safety: We make no warranties about the safety of any location
• Third-Party Content: We are not responsible for external links or references

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• No Liability for Damages: We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Damage Cap: Our total liability is limited to the amount you paid for premium services (if any) in the 12 months preceding the claim
• Personal Injury: We are not liable for any injuries, accidents, or damages that occur while visiting locations
• Data Loss: We are not liable for any loss of data, though we implement reasonable backup measures

11. Indemnification

You agree to defend, indemnify, and hold harmless Smultron and its affiliates from any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your submitted content
• Your violation of these Terms
• Your violation of any third party's rights
• Any activities conducted through your account

12. Account Termination

12.1 Termination by You

You may delete your account anytime through the App settings:

• Your personal data will be removed
• Your account access will be terminated
• The deletion process requires reauthentication for security

12.2 Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms or our Privacy Policy
• Engage in prohibited conduct
• Submit inappropriate or harmful content
• Attempt to circumvent security measures or submission limits
• Use the App in ways that harm our service or other users

12.3 Effect of Termination

Upon termination:

• Your access to the App will cease immediately
• Your personal data will be deleted (subject to legal retention requirements)
• Your submitted content will be deleted
• Premium subscription benefits will end (subject to App Store refund policies)

13. Changes to Terms

We may modify these Terms from time to time. When we do:

• Notification: We will notify you through the App or email
• Effective Date: Changes take effect on the date specified in the updated Terms
• Continued Use: Your continued use after changes constitutes acceptance
• Material Changes: Significant changes may require explicit acceptance

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of Sweden, without regard to conflict of law provisions.

14.2 Dispute Resolution

For any disputes arising from these Terms or your use of the App:

1. Direct Communication: We encourage contacting us directly first
2. Mediation: Disputes may be resolved through mediation
3. Arbitration: Binding arbitration may be required for certain disputes
4. Jurisdiction: Swedish courts have jurisdiction for legal proceedings

14.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class action lawsuits.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Smultron regarding the App.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15.3 Assignment

We may assign these Terms or our rights hereunder without notice. You may not assign your rights under these Terms.

15.4 No Waiver

Our failure to enforce any provision does not constitute a waiver of our right to enforce it later.

15.5 Survival

Provisions that by their nature should survive termination will continue to apply after these Terms end.
